NOVA Terms of Service

1. Eligibility and Account Registration

You must be at least 18 years old to use NOVA. By using the Service, you confirm that:

• You meet the age requirement.
• You are capable of entering into a binding contract.
• All information you provide is accurate and complete.

2. SMS Messaging Terms & Conditions

When you create an account with NOVA, you are required to provide a valid mobile phone number and consent to receive SMS messages from us. These messages are used only for account verification, login security, and related account alerts. We do not use SMS for marketing or promotional content.

• Program Description: SMS messages from NOVA are used solely to deliver one-time passcodes (OTP) and security alerts related to your account.
• Message Frequency: You will typically receive one message per login attempt or account activity requiring verification. Message frequency may vary based on your use of the application.
• Message & Data Rates: Message and data rates may apply, depending on your mobile carrier plan.
• Opt-Out: If you reply STOP, we will cease sending SMS messages to your number. However, because SMS is required to verify your identity and protect your account, opting out will suspend your ability to log in or use the application. You may opt back in by replying START or re-enabling SMS in your account settings.

• Supported Keywords: In addition to STOP and HELP, the following keywords are recognized: STOPALL, END, QUIT, CANCEL, UNSUBSCRIBE, OPTOUT, REVOKE (for opt-out) and START, UNSTOP, YES (to re-enable).
• Privacy: We will not share, sell, or rent your mobile phone number or SMS opt-in data with third parties or affiliates for marketing or promotional purposes. Please review our Privacy Policy for more details.
• Terms & Privacy Links: By creating an account and providing your phone number, you agree to these Terms of Service and our Privacy Policy.

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

3. Description of Service

NOVA is a personal emotional AI copilot designed to:

• Analyze your written and spoken communication,
• Detect behavioral and emotional patterns,
• Offer insights, simulate potential outcomes, and
• Facilitate clearer communication and conflict resolution.

NOVA is not a substitute for mental health services, legal counsel, or medical advice.

4. Acceptable Use

You agree to use NOVA only for lawful, respectful, and constructive purposes. You may not:

• Use NOVA to harass, manipulate, or impersonate others.
• Input or transmit harmful, violent, sexually explicit, or abusive content.
• Violate any applicable laws, regulations, or third-party rights.
• Attempt to reverse engineer or interfere with the operation of the Service.

5. AI Limitations and No Guarantees

While NOVA provides personalized insights, it:

• May generate content that is inaccurate, biased, or inappropriate.
• Is not capable of fully understanding your context, relationships, or emotional state.
• Does not guarantee outcomes, predictions, or emotional accuracy.

All insights and suggestions should be used at your discretion. You are solely responsible for the decisions you make based on NOVA's output.

6. Data Usage and User Content

You may upload or sync personal data including messages, call logs, emails, voice memos, or social media content ("User Content") for analysis.

By doing so, you grant NOVA:

• A non-exclusive, revocable, and limited license to process your User Content solely for the purpose of providing the Service.
• Permission to use anonymized and aggregated data to improve the product, algorithms, and user experience (you may opt out in settings).

You retain full ownership of your content. We do not sell your personal data.

7. Third-Party Integrations

If you choose to connect your account with third-party services (e.g., Gmail, iMessage, WhatsApp, Instagram), you authorize NOVA to access, process, and analyze your data from those platforms solely to provide the Service.

NOVA is not responsible for the accuracy, availability, or content of those third-party services.

8. Mediator and Conflict Resolution Features

NOVA may offer tools to help you navigate interpersonal conflict by:

• Generating neutral feedback,
• Acting as a communication bridge,
• Simulating the perspectives of others based on available data.

You agree not to use this feature to coerce, manipulate, or emotionally harm others. NOVA does not act as a licensed mediator, therapist, or legal arbitrator.

9. Privacy and Security

Your privacy matters. Please review our Privacy Policy for full details on how your data is collected, stored, and used.

NOVA uses encryption and security protocols to protect your data, but no system is 100% secure. You use the Service at your own risk.

10. Subscription, Payments, and Cancellations

NOVA offers subscription-based access. By subscribing, you agree to recurring billing unless you cancel.

• Refunds are not guaranteed and are granted at our sole discretion.
• You may cancel your subscription at any time through your account settings. Upon cancellation, you retain access through the end of the billing cycle.

11. Intellectual Property

All NOVA content, designs, software, trademarks, and technology are owned by Nova AI Corporation, Inc. or its licensors.

You may not copy, modify, distribute, or create derivative works from NOVA's intellectual property without written permission.

12. Termination

We reserve the right to suspend or terminate your access to NOVA:

• If you violate these Terms,
• For suspected fraud or misuse,
• Or if continued use would cause harm to NOVA, its users, or its brand.

Upon termination, your right to use the Service immediately ceases.

13. Disclaimers and Limitation of Liability

The NOVA service is provided "as is" and "as available" without warranties of any kind.

To the fullest extent permitted by law:

• NOVA disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• NOVA shall not be liable for indirect, incidental, special, or consequential damages arising out of your use or inability to use the Service.

14. Dispute Resolution and Arbitration

Any dispute arising from these Terms or your use of NOVA will be resolved through binding arbitration in Austin, Texas under the rules of the American Arbitration Association.

You waive your right to a jury trial or class action.

15. Modifications to Terms

We may update these Terms from time to time. We will notify users of material changes, and continued use of the Service after updates constitutes acceptance of the revised Terms.
